EULA-TTMM-R
TTMM-R for Pebble Time 2
END USER LICENCE AGREEMENT
1. General Provisions
1.1.
This End User Licence Agreement (“EULA”) is a legal agreement between you (“User”, “you”) and TTMM Spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Warsaw, Poland, address: ul. Stefana Batorego 18 lok. 108, 02-591 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number: 0000789113, Tax Identification Number (NIP): 7010928954, REGON: 383528253, share capital of PLN 5,000 (“TTMM”, “we”).
1.2.
The EULA governs the use of the watchfaces of the collection TTMM-R for Pebble Time 2 listed in Section 17 (each a “Software”). Each Software consists of the watch application, its companion component running inside the Pebble mobile application on your phone, and its settings page, together with the Weather Service: the TTMM server at api.ttmm.is that delivers weather and air-quality data to the Software.
1.3.
By installing, running or purchasing a licence for a Software you accept this EULA. If you do not accept it, do not install the Software, or uninstall it.
1.4.
Each Software is a watchface: it shows the time and, around it, information you choose in its settings: date, calendar data, weather, air quality, the sun and the moon, and health readings from your watch. It is not a medical device and not a safety system (see Sections 10 and 11).
2. Licence, Trial and Renewal
2.1.
Subject to this EULA, TTMM grants you a non-exclusive, non-transferable, revocable licence to install and use the Software for your personal, non-commercial purposes on Pebble Time 2 watches paired with your Pebble account. Each Software is licensed separately: a trial or a licence for one watchface of the collection does not cover another.
2.2.
Trial. The Software may be used free of charge for the trial period stated in Section 17, seven (7) days unless stated otherwise, from its first launch on your account. During the trial all functions, including the Weather Service, are available. Choosing Purchase Now in the Software’s settings ends the trial at once and starts the purchase. The trial is offered in addition to the rights described in Sections 2.5 and 10.3; it does not replace, shorten or condition them.
2.3.
Yearly licence. After the trial, continued use requires a paid licence valid for one (1) year at the price stated in Section 17, as displayed at the time of purchase. The Software shows a five-digit code on the watch; the purchase is completed at kzl.io/code by entering that code and paying. The purchase and the payment are handled by KiezelPay (kiezelpay.com, kzl.io/code), an independent payment service with its own terms and privacy policy. TTMM does not receive your payment details. The licence itself is granted by TTMM, and TTMM is the party liable to you for the Software and the Weather Service. Until the licence is purchased, the purchase screen stays on the watch in place of the watchface.
2.4.
Renewal. The licence is tied to your Pebble account. After a new phone or a reinstall of the Pebble application, the Software may show its purchase screen again; the licence is then moved to the new installation free of charge at kzl.io/code, with Already Purchased and the e-mail address used for the purchase. It is not a subscription: nothing is charged automatically and no payment details are kept for a renewal. When the year ends, the Software shows its purchase screen again, in place of the watchface, and keeps it there until a new licence is purchased or you choose another watchface; the Weather Service stops answering requests from your account. Renewing means purchasing a new one-year licence in the same way as the first.
2.5.
Right of withdrawal. Where you are a consumer in the European Union or the European Economic Area, you may withdraw from the purchase of a licence within fourteen (14) days of its conclusion, without giving any reason, even though the Software and the Weather Service become available to you at once. To withdraw, send an unequivocal statement to the address in Section 16.6. TTMM will arrange the refund of the price paid without undue delay and no later than fourteen (14) days after receiving your statement.
2.6.
The Software uses the Weather Service to verify that your account holds a valid trial or licence. Copies of the Software installed outside the trial or a valid licence receive no weather data.
2.7.
Free Software. A Software listed in Section 17 as free of charge may be installed and used without a fee, without a trial and without time limit. It has no Weather Service and no licence check: Sections 2.2 to 2.6, Section 5 and the provisions of Section 7 that concern the Weather Service do not apply to it, and it sends no position and no identifiers to TTMM.
3. Permitted Use and Restrictions
3.1.
You may install the Software on any Pebble Time 2 watch paired with the Pebble account under which the licence was purchased.
3.2.
You may not:
a) copy, distribute, sell, rent, lend or sublicense the Software,
b) modify, decompile, disassemble or reverse engineer the Software or its companion component, except to the extent expressly permitted by mandatory law,
c) circumvent, disable or interfere with the licence check, the trial, or the Weather Service,
d) use the Weather Service from anything other than the unmodified Software,
e) extract, copy or reuse the typefaces, glyphs, screens or graphics of the Software, which are protected works of TTMM,
f) use the Software for commercial purposes without a separate written agreement with TTMM.
3.3.
All rights not expressly granted in this EULA are reserved by TTMM. The Software, its typefaces and all related materials are protected by copyright, industrial design and other intellectual property laws.
3.4.
The Pebble mobile application and the Pebble appstore are services of Core Devices, provided under their own terms; this EULA does not govern them.
4. Technical Requirements
4.1.
The Software requires a Pebble Time 2 watch and the Pebble mobile application on an iOS or Android phone, connected over Bluetooth.
4.2.
Weather, air quality, sunrise, sunset, golden hour and moon phase require the phone to have an internet connection and to grant the Pebble application access to location. Without them the Software shows the last data it received or marks the data as unavailable, and reports that it is offline.
4.3.
Heart rate, steps, distance, active time, sleep and calories require Pebble Health to be enabled on the watch. Without it the related lines show no value and, where the Software has a reminder to move, it behaves as if every hour were sedentary.
4.4.
The Software is distributed only through TTMM Stream, TTMM’s own source at apps.ttmm.is, added in the Pebble application. Updates are installed through the Pebble application.
5. The Weather Service
5.1.
The Weather Service is operated by TTMM. Weather and air-quality data originate from Open-Meteo (open-meteo.com), which TTMM queries on your behalf under its own commercial plan. Data are provided as received from Open-Meteo; TTMM does not verify them.
5.2.
What your phone sends. For each refresh (twice an hour, and after a wrist shake when the last reading is older than ten minutes) the companion component sends to api.ttmm.is: your position rounded to 0.01 degree (about one kilometre), the name of the Software, the Pebble account and watch identifiers that KiezelPay uses for the licence, a random number the watch uses to authenticate the server’s reply, and a signature of the request. Nothing else: no name, no e-mail, no health data, no settings.
5.3.
What the server does with it. The server asks KiezelPay whether your account holds a trial or a licence, fetches the weather and air quality for your rounded position from Open-Meteo, and returns them to the Software. Open-Meteo receives only the rounded coordinates, from TTMM’s server; it does not receive your identifiers.
5.4.
What the server keeps. The weather answer for a rounded position, for fifteen (15) minutes, so that many watches in one area cause one request to Open-Meteo. The licence status of your account, stored under a one-way hash of the identifiers, together with the dates of its last confirmation by KiezelPay and of its end, for as long as the watch may still rely on that confirmation and in any case no longer than eight (8) days. A service log holding the date and time of each request, the name of the Software, the rounded position and the licence status, no identifiers, kept for no longer than sixty (60) days for the purpose of operating and securing the service. The hosting provider of api.ttmm.is, acting on TTMM’s behalf, records each request in its standard access and security logs: the IP address of the connection, the date and time, the type of app and the address requested, which carries the parameters described in Section 5.2. These logs are kept for the limited period needed to operate and secure the server, and TTMM does not combine them with the licence status or the service log.
5.5.
TTMM may change the data provider, the refresh interval or the technical design of the Weather Service for a valid reason: the end or the change of an agreement with a data provider, a security requirement, or a change in the technical environment on which the service depends, provided the Software keeps delivering the data described in Section 1.4, the change costs you nothing, and you are informed of it clearly in advance. Where such a change would materially and negatively affect your access to the Software or the Weather Service, you may terminate your licence within thirty (30) days of the change or of being informed of it, whichever is later, and receive a refund of the price in proportion to the unused part of the licence term.
5.6.
Availability. The Weather Service depends on Open-Meteo, KiezelPay, the internet and your phone. TTMM does not guarantee its uninterrupted availability. When KiezelPay cannot be reached, the Weather Service may serve data to an account whose status it cannot verify at that moment.
5.7.
Discontinuation. TTMM may discontinue the Weather Service. In that event TTMM will stop selling new licences and renewals, and every licence already purchased will keep receiving the Weather Service until its own end date.
6. Data on the Watch
6.1.
Heart rate, steps, distance, active time, sleep and calories are read from Pebble Health on the watch, used only to display them and to decide when a line pulses or a screen appears, and are never transmitted to TTMM or to anyone else by the Software.
6.2.
Your settings are stored on the watch and in the settings storage of the Pebble application on your phone. TTMM does not receive them.
6.3.
The Software creates no TTMM account, contains no analytics, no tracking and no advertising.
7. Personal Data
7.1.
For the data described in Section 5, TTMM is the controller within the meaning of the General Data Protection Regulation (GDPR). The data are processed to perform this EULA (Article 6(1)(b) GDPR): to verify the licence and to deliver weather and air-quality data to your watch. Retention periods are those stated in Section 5.4. The access logs described in Section 5.4 are processed on the basis of TTMM’s legitimate interest in operating and securing the service (Article 6(1)(f) GDPR).
7.2.
The account and watch identifiers are pseudonymous identifiers generated by the Pebble platform; TTMM cannot link them to your name; the Weather Service stores them only as one-way hashes, and they appear in clear only in the access logs described in Section 5.4, for the limited period stated there. Health data never reach TTMM; TTMM processes no special categories of personal data.
7.3.
Recipients: Open-Meteo (weather and air-quality provider, receives rounded coordinates from TTMM’s server), KiezelPay (licence status; for purchases and payments KiezelPay is a separate controller under its own privacy policy), and Progreso, the hosting provider of api.ttmm.is, which processes data on TTMM’s behalf.
7.4.
You have the right of access, rectification, erasure, restriction, objection and data portability, and the right to lodge a complaint with a supervisory authority (in Poland: Prezes Urzędu Ochrony Danych Osobowych). Requests may be sent to the contact address in Section 16. Because the service log holds no identifiers, a request concerning it can be honoured only for the licence-status entries, which expire within the period stated in Section 5.4 in any case.
8. Termination
8.1.
The licence ends when its year ends without renewal, when you uninstall the Software, or when TTMM terminates it for a breach of this EULA. On a breach, termination is immediate.
8.2.
TTMM may withdraw a Software from distribution or discontinue the Weather Service under Section 5.7. Withdrawal from distribution does not end licences already paid for; they run to their end date.
8.3.
On termination you must uninstall the Software from all your watches.
9. Limitation of Liability
9.1.
TO THE FULLEST EXTENT PERMITTED BY LAW, TTMM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF DATA, LOSS OF PROFITS OR LOSS OF USE ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE WEATHER SERVICE.
9.2.
In particular, TTMM shall not be liable for:
a) the accuracy, completeness or timeliness of weather, air-quality, pollen, UV, astronomical or health data shown by the Software,
b) any decision you take, or fail to take, on the basis of a screen, a line, a chime or the absence of one,
c) interruptions of the Weather Service caused by Open-Meteo, KiezelPay, the hosting provider, the Pebble platform, your phone or your internet connection,
d) battery consumption resulting from the settings you choose.
9.3.
TTMM’S TOTAL LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE CONCERNED IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9.4.
Nothing in this EULA excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection law. Sections 9.1 to 9.3 do not affect the rights described in Section 10.3.
10. Warranties, Updates and Conformity
10.1.
SUBJECT TO SECTION 10.3, THE SOFTWARE AND THE WEATHER SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TTMM DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.
10.2.
Updates. For as long as the Software and the Weather Service are supplied to you under a valid licence, TTMM will provide the updates necessary to keep them in conformity with this EULA, and will inform you of them through the Pebble application. Updates that add new functions, and support beyond what mandatory law requires, are provided at TTMM’s discretion. Where TTMM has made a necessary update available and informed you of it, TTMM is not liable for a lack of conformity resulting solely from your failure to install it, provided that the failure was not caused by shortcomings in the installation instructions.
10.3.
Conformity. Where you are a consumer, TTMM is liable to you for any lack of conformity of the Software or the Weather Service with this EULA which occurs or becomes apparent during the period for which they are supplied, that is, throughout the term of your licence, and not only during the trial. If they are not in conformity, you may require TTMM to bring them into conformity; where TTMM fails to do so within a reasonable time and without significant inconvenience to you, or where doing so is impossible or would cause disproportionate cost, you may request a proportionate reduction of the price or withdraw from the contract, unless the lack of conformity is minor. A reduction or a refund is calculated in proportion to the period during which the Software or the Weather Service was not in conformity and to the unused part of the licence term; TTMM is not entitled to payment for the time during which they were not in conformity.
10.4.
Where to claim. Claims concerning conformity are addressed to TTMM at the contact details in Section 16.6, and are handled by TTMM. KiezelPay handles the purchase and the payment and operates its own refund policy; that policy is a further route open to you and does not limit, replace or condition the rights you hold against TTMM under this Section or under mandatory consumer law.
11. Not a Medical or Safety Device
11.1.
The heart-rate, UV, air-quality, pollen, temperature and weather screens and indicators are for general information only. They rely on the watch’s sensors, on Pebble Health and on third-party data of limited resolution, and may be late, inaccurate or missing.
11.2.
The Software does not diagnose, treat or prevent any condition and does not replace medical advice, weather warnings issued by public authorities, or your own judgement. Do not rely on it for decisions affecting health or safety.
12. External Services
12.1.
The Software works with services of third parties: Core Devices (the Pebble application and appstore), KiezelPay (purchases and licences) and Open-Meteo (weather and air-quality data, provided under the Creative Commons Attribution 4.0 licence, “Weather data by Open-Meteo.com”). Each of them is governed by its own terms. TTMM is not responsible for their content, availability or conduct.
12.2.
TTMM may suspend the Software’s access to an external service without notice where required for legal, technical or security reasons. Where such a suspension lasts long enough to affect your use of the Software, Section 10.3 applies.
13. Assignment
13.1.
TTMM may assign its rights and obligations under this EULA to a third party without your consent. You may not assign your licence.
14. Governing Law and Jurisdiction
14.1.
This EULA is governed by, and construed in accordance with, the laws of Poland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Where you are a consumer, this choice does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence, and the courts of that country remain competent: TTMM may bring proceedings against you only there, while you may bring proceedings against TTMM either there or before the court in Warsaw competent for TTMM’s registered office. In all other cases, disputes arising out of or in connection with this EULA are resolved exclusively by the court in Warsaw competent for TTMM’s registered office.
15. Severability and Indemnification
15.1.
If any provision of this EULA is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be replaced by a valid one that comes closest to its purpose.
15.2.
You shall indemnify and hold TTMM harmless from any claims, damages, losses and costs, including reasonable attorney fees, arising from your breach of this EULA or from your use of the Software in violation of third-party rights or applicable law. This Section does not apply where you are a consumer.
16. Miscellaneous
16.1.
TTMM alone is responsible for the content of this EULA; Core Devices, KiezelPay and Open-Meteo are not parties to it.
16.2.
This EULA supersedes all prior terms concerning the Software, including the End User Licence Agreement for TTMMBRN-R for Pebble Time 2 of September 17, 2026 (version 1.1). TTMM may amend it; material changes will be announced at least fourteen (14) days before they take effect, on ttmm.is or in the Software’s settings page. Continued use after that date means acceptance; if you do not accept the change, uninstall the Software and, where applicable, do not renew. An amendment does not reduce the rights you hold in respect of a licence already purchased.
16.3.
Any commercial use of the Software requires a separate written agreement with TTMM.
16.4.
Nothing in this EULA limits the rights that mandatory consumer law grants you.
16.5.
This EULA is drawn up in English. Any translation is for convenience only; the English version prevails.
16.6.
Any notice, communication or statement, as well as all claims and requests regarding the Software or this EULA, shall be sent by email to: biuro@ttmm.com.pl or by letter to the address: TTMM Sp. z o.o., ul. Stefana Batorego 18 lok. 108, 02-591 Warsaw, Poland. Complaints concerning the Software should be submitted within thirty (30) days of the event they concern; TTMM will respond within thirty (30) days of receipt. The thirty-day period for submitting a complaint does not apply to consumer claims under Section 10.3 or to the right of withdrawal under Section 2.5.
17. Covered Software
17.1.
This EULA covers the following watchfaces of the collection TTMM-R for Pebble Time 2, each with its trial period and the price of its one-year licence (plus applicable local taxes, as displayed at the time of purchase), or marked as free of charge:
a) TTMMBRN-R. Trial: seven (7) days; licence: one (1) year, USD 12.
b) TTMMBRN-B. Free of charge: no trial, no licence fee and no Weather Service (Section 2.7).
17.2.
Watchfaces are added to this list as they are released. The version of this EULA in force at the time of your purchase applies to that licence; Section 16.2 governs later changes.
